Terms of Service
These Terms of Service govern reservations, transportation, recovery assistance, winter services, and other services provided by Brian Head Drivers LLC (“Brian Head Drivers,” “we,” “us,” or “our”). By making a reservation, submitting a custom transportation request, purchasing a service, or using our services, you agree to these Terms of Service.

1. Services
Brian Head Drivers provides private passenger transportation and related transportation and roadside assistance services in Southern Utah and surrounding service areas as offered by Brian Head Drivers.
Services may include predefined transportation routes, airport transportation, custom transportation, local transportation, vehicle recovery assistance, jump starts, tire air assistance, fuel delivery, mobile EV charging, snow-chain delivery, low-visibility escort services, de-icer delivery, cabin or property welfare checks, and other services specifically offered or approved by Brian Head Drivers.
Service availability varies based on location, weather, road conditions, vehicle and driver availability, scheduling, equipment requirements, and other operational considerations. Submission of a request does not guarantee that Brian Head Drivers will accept or provide the requested service.
2. Standard Route Reservations
Standard Route Reservations are predefined transportation services offered through our online booking system. The pickup and destination locations, route, passenger capacity, and other applicable service parameters are established during booking.
Standard Route Reservations are direct transportation services and do not include customer-requested stops, waiting time, itinerary changes, sightseeing, errands, or other customization unless specifically stated in the booked product.
Stops or route adjustments may be made when Brian Head Drivers determines they are reasonably necessary because of an emergency, safety concern, road or weather conditions, law-enforcement activity, or other operational circumstances.
Customers requiring stops, waiting time, multiple destinations, special routing, or other itinerary customization should use our Custom Transportation service.
3. Custom Transportation
Custom Transportation is intended for transportation requests requiring individualized routing, stops, waiting time, scheduling, passenger or equipment requirements, or other services outside our predefined Standard Route Reservations.
Quotes and estimates are based on the information supplied by the customer. Changes to the itinerary, mileage, duration, passenger count, vehicle requirements, stops, waiting time, or other service requirements may result in additional charges.
Submission of a Custom Transportation request or receipt of an estimate does not create a confirmed reservation. A reservation is confirmed only after Brian Head Drivers approves the request and any required payment has been received.
4. Reservations & Payment
Customers are responsible for providing complete and accurate information when making a reservation or requesting service, including pickup and destination information, date and time, passenger count, contact information, luggage or equipment requirements, and any other information reasonably necessary to provide the service.
Prices and payment requirements are presented during booking, quotation, or approval. Unless otherwise stated, payment is required before service is confirmed.
Reservations are not transferable or resalable without prior approval from Brian Head Drivers.
Brian Head Drivers may decline or cancel a reservation when information provided by the customer is materially inaccurate, when the requested service cannot reasonably or safely be performed, or when other circumstances prevent fulfillment of the reservation.
5. Passengers, Luggage & Equipment
Customers are responsible for accurately reporting the number of passengers and the type and quantity of luggage, recreational equipment, mobility devices, or other items requiring transportation.
Brian Head Drivers may refuse to transport passengers or items that exceed the safe or legal capacity of the assigned vehicle or that were not reasonably disclosed before service.
Customers must comply with applicable seat-belt, child-restraint, passenger-safety, and other legal requirements. Customers are responsible for supplying any required child safety or booster seats unless Brian Head Drivers expressly agrees otherwise.
Wheelchairs and other mobility devices may be transported when they can be safely accommodated as luggage or oversized items. Unless expressly agreed otherwise, Brian Head Drivers does not provide wheelchair-accessible vehicles or passenger transfer assistance, and members of the customer’s party are responsible for assisting the passenger into and out of the vehicle.
6. Vehicles & Vehicle Assignment
Vehicle photographs, descriptions, and preferences may be provided to help customers understand our fleet. Unless a particular vehicle is expressly guaranteed as part of a confirmed reservation, Brian Head Drivers may substitute another suitable vehicle when reasonably necessary because of availability, maintenance, weather, safety, scheduling, passenger capacity, or other operational requirements.
Any substituted vehicle will be selected with consideration for the requirements of the confirmed transportation service.
7. Pickup Times, Delays & No-Shows
Customers are responsible for being ready at the confirmed pickup location at the scheduled time and for providing accurate contact and transportation information.
Customers who expect to be delayed should contact Brian Head Drivers as soon as possible. We will make reasonable efforts to accommodate delays when scheduling and other reservations permit, but waiting time or schedule changes are not guaranteed and may result in additional charges.
A customer who is unavailable at the scheduled pickup location and cannot reasonably be contacted may be considered a no-show.
For airport transportation, customers are responsible for providing accurate flight information when requested. When Brian Head Drivers is aware of a flight delay, we will make reasonable efforts to adjust the pickup, subject to driver and vehicle availability and other confirmed reservations.
8. Weather, Roads & Safety
Brian Head Drivers operates in mountain environments where snow, ice, wind, reduced visibility, road closures, traffic incidents, chain restrictions, and rapidly changing conditions may affect transportation.
Safety decisions regarding whether a route or service can reasonably be performed are made by Brian Head Drivers based on current conditions, road access, vehicle capability, applicable restrictions, and other relevant operational factors.
Brian Head Drivers may alter routes, timing, pickup locations, vehicles, or other operational details when reasonably necessary for safety or changing conditions.
Customers and passengers must follow reasonable safety instructions provided by the driver. Brian Head Drivers may refuse or discontinue service when customer conduct, road conditions, passenger behavior, cargo, or another circumstance creates an unreasonable safety risk.
9. Recovery & Roadside Assistance Services
Recovery, extraction, jump-start, tire-air, fuel-delivery, mobile EV-charging, chain-delivery, escort, and similar services are assistance services and do not guarantee that a disabled or stuck vehicle can be recovered, started, repaired, charged sufficiently to complete a journey, or otherwise returned to operation.
Brian Head Drivers does not provide conventional towing, collision towing, mechanical repair, or operation of a customer’s vehicle unless a specific service expressly states otherwise.
Some recovery or assistance services may require the customer to acknowledge additional terms or a waiver before service is performed.
The customer is responsible for accurately describing the vehicle, location, terrain, conditions, and circumstances of the requested assistance. Brian Head Drivers may decline or discontinue an attempted service if conditions are unsafe, access is inadequate, required equipment is unavailable, or the service is outside our capabilities.
10. Customer Conduct
Passengers must behave in a manner that does not threaten the safety of the driver, other passengers, the vehicle, or the public.
Brian Head Drivers may refuse or terminate service because of threatening, abusive, violent, severely disruptive, unlawful, or unsafe conduct. Service may also be refused when a passenger’s condition or behavior creates an unreasonable safety risk.
Customers may be responsible for reasonable cleaning, repair, remediation, or other costs resulting from damage or excessive cleaning caused by members of their party, to the extent permitted by applicable law.
11. Cancellations, Changes & Refunds
Cancellations, reservation modifications, refunds, customer delays, no-shows, weather-related cancellations, and related matters are governed by our Cancellation & Changes Policy, which is incorporated into these Terms of Service by reference.
Standard Route Reservations and Custom Transportation may be subject to different cancellation and modification rules.
Where optional third-party refund protection is offered during checkout, that protection is separate from Brian Head Drivers’ cancellation policy and is governed by the applicable third-party provider’s terms.
12. Third-Party Services
Brian Head Drivers may use third-party platforms and service providers for reservations, payment processing, communications, mapping, refund protection, or other business functions.
Use of those services may also be subject to the third party’s applicable terms and privacy practices. Brian Head Drivers is not responsible for determining eligibility or administering benefits provided independently by a third-party refund-protection provider.
13. Personal Property
Customers are responsible for their personal property.
Customers should inspect the vehicle and surrounding area for belongings at the conclusion of service. Brian Head Drivers will make reasonable efforts to identify and return property found in our vehicles, but we cannot guarantee recovery or return of lost or forgotten items.
Reasonable shipping, delivery, or other costs associated with returning property may be charged to the customer.
14. Circumstances Beyond Our Control
Transportation and other services may be affected by circumstances outside Brian Head Drivers’ reasonable control, including severe weather, road closures, accidents, traffic incidents, government or law-enforcement restrictions, utility or communications outages, natural events, or other unforeseen conditions.
Brian Head Drivers will make reasonable efforts to provide confirmed services safely and communicate material disruptions when practicable.
Refund eligibility when a service is affected or cannot be provided is governed by our Cancellation & Changes Policy.
15. Website & Pricing Information
Brian Head Drivers makes reasonable efforts to keep website descriptions, availability, pricing, vehicle information, and other published information accurate.
Errors, technical problems, incorrect availability, mapping errors, or other unintended discrepancies may occasionally occur. Brian Head Drivers reserves the right to correct an obvious error before confirming a reservation or service.
Nothing on the website constitutes a guarantee of availability until the applicable reservation has been confirmed.
16. Limitation of Liability
To the fullest extent permitted by applicable law, Brian Head Drivers is not responsible for indirect, incidental, special, or consequential losses arising from delays, missed connections, changed travel plans, road closures, weather conditions, or other circumstances outside our reasonable control.
Nothing in these Terms is intended to waive or limit any right or liability that cannot lawfully be waived or limited.
17. Changes to These Terms
Brian Head Drivers may update these Terms of Service from time to time. The current version will be posted on our website with its effective or last-updated date.
Unless otherwise required by law, the terms applicable to a confirmed reservation will be those applicable to that reservation at the relevant time.
